Full Release: Macomber Report Alleges Open Meeting Violations, Improprieties By State Appointed Board, And Alleges The Hiring of NIC President Nick Swayne Was Illegal

This one is gonna be a doozey.

The Macomber Report has been released in full by the North Idaho College Board of Trustees.

Below is the first 36 pages of the report in which NIC’s attorney, Art Macomber, alleges a string of improprieties and potentially illegal practices that occurred during the hiring of NIC’s president Nick Swayne.

Last night, at the Board of Trustees meeting, Swayne’s contract was declared to be null and void due to open meetings violations, however Swayne remains president of the college.

With regards to open meeting laws, the Press and liberal activist groups have incorrectly reported on what the Open Meetings Law in Idaho actually says, falsely alleging that there is a “statue of limitations” of 180 days, during which time the governing body may “cure” the violations.

This is not what Idaho Code 74-208 says:

Idaho Code says that you have 180 days to file a lawsuit against a governing body that broke open meetings laws. It does not say that once those 180 days are up that nothing can or should be done to fix the violation.

The law says that the “governing body shall have fourteen (14) days to respond publicly and either acknowledge the open meeting violation and state an intent to cure the violation, or state that the public agency has determined that no violation has occured.”

Last night, we saw that the governing body stated that a violation DID occur and as such, nullified Dr. Swayne’s contract. This means that the board was notified of these violations (likely on April 14th, the date on the Macomber Report) and took action within that 14 day period.
