“Children’s School and Library Protection Act” Would Allow Parents To Sue Schools & Libraries That Give Harmful Materials To Minors - HB.139

A new bill called the “Children’s School and Library Protection Act,” also known as HB139 was introduced by Representative Jaron Crane (LD-12b), and Senator Cindy Carlson (LD-7). The bill is currently in the house, and public testimony could come as soon as this week.

The bill will remove an exemption that libraries and schools currently have, that has made them immune from prosecution. So, if your child had been given access to obscene materials by the library, or their schools, there’s nothing you could do about it.

We actually saw a parent complaining about this when her child checked out a book that contained pornography at the last Community Library Network Board Meeting.

Once this bill passes, that will no longer be the case.

Blaine Conzatti from the Idaho Family Policy Center said:

“The Children’s School and Library Protection Act would create a statewide policy that prohibits schools and libraries from distributing pornographic material to minor children. Any violation of the policy would result in civil liability for the offending institution.”

“No parent wants their child encountering sexually explicit books at their school or community library. This legislation aims to protect our children’s innocence—and that’s a battle worth fighting.”
